ANALYSIS OF REGULATORY LEGAL ACTS STIPULATING THE REQUIREMENTS FOR THE RESTORATION OF HEALTH CARE FACILITIES

Summary:
Introduction. Healthcare in the Russian Federation is one of the priority sectors of the economy, which is associated with a significant contribution to social and economic development and preservation of national health. Under modern conditions, one of the key challenges facing healthcare is improving the accessibility and quality of health care for people in every region of the country. The prospect of “fine-tuning” healthcare depending on specific characteristics of the Russian regions, such as their size, geographical and climatic conditions, population density, transport accessibility of health care facilities, and the level and overall structure of morbidity, is becoming particularly important. One of the objectives of the Russian healthcare system is to establish and maintain a regulatory-compliant infrastructure that meets two key criteria: accessibility for the public and economic feasibility.
The purpose of the study is to analyze the regulatory legal framework for capital repairs and reconstruction of health care facilities at the federal and regional levels in order to prioritize health care facilities for capital repairs or reconstruction. Sources of information were selected based on the following keywords: health care facilities, organization of health care delivery, capacity, and capital repairs. A total of 190 sources of information were selected, including 160 regulatory legal acts.
Material and methods. The source of the information was regulatory legal acts from the ConsultantPlus and Garant legal reference systems. The study employed descriptive and analytical methods.
Results and Discussion. Issues related to the restoration of health care facilities are addressed in regulatory legal acts at the federal level. The conducted analysis of 160 different-level regulatory legal acts on the restoration of health care facilities showed that these issues are regulated by federal laws and subordinate acts of the Government of the Russian Federation, the Ministry of Health of the Russian Federation, the Ministry of Construction, Housing and Utilities of the Russian Federation, as well as documents defining the requirements of sanitary rules and standards. At the same time, regulatory legal acts mostly contain general principles for the requirements for the placement of medical organizations, general principles of territorial planning, as well as criteria for capital repairs in terms of the operational characteristics of buildings and structures. Thus, the regulatory framework needs to be improved at various levels and across different agencies to clarify the legal norms governing the criteria and conditions influencing prioritization of health care facilities for capital repairs and reconstruction. Currently, regulatory legal documents in healthcare outline the requirements for the types, terms and volumes of health care delivery at different health care facilities, mainly depending on the size of the catchment area, without taking into account other factors that affect the organization of health care delivery. Therefore, regulatory legal acts do not stipulate the order or necessity of carrying out capital repairs or reconstruction.
Conclusion. The study has identified the need for improving the regulatory framework for prioritizing health care facilities that require restoration.
